Terms & Conditions

1. This contract is based on an initial six (6)month period, thereafter converts to a month to month contract at the current month to month rates, or is renewable for a further six (6) months at the current discounted subscription rate. Members will be notified of the contract expiry 30 days prior to the expiry date and must inform Bodyguru in writing of their intentions of renewal or cancellation.
2. Should no correspondence in writing be received from the member regarding their right to renew or terminate the contract, said contract will automatically be renewed for a further six (6) months. The same terms and conditions of renewal / cancellation will apply.
3. Should the member wish to terminate the contract with Bodyguru, the member is required to inform Bodyguru of their intentions in writing at least one calendar month prior to date of cancellation. The membership shall only be terminated after the initial regulatory six (6) month contract period has expired.
4. Should the member have paid subscriptions in advance for either a six (6) or twelve (12) month contract at discounted monthly rates, and cancel within the contractual period, no refunds will be made.
5. Contracts are NOT transferable.
6. Should the members monthly debit order payment be rejected for whatever reason, it is the duty of said member to remedy payment to Bodyguru within five (5) days of the debit order being returned. Should payment still be outstanding after such date, the members access to the facility shall be temporarily suspended until such time as all fees due, including penalties, are received by Bodyguru. Should no payment be received by Bodyguru by the end of said current month, Bodyguru will then terminate the members contract in full and legal action will be instituted to recover all outstanding contractual fees, including legal costs on the scale as between attorney and own client, inclusive of any collection commissions, if any.
7. All legal actions and disputes will be processed through the Alberton Magisterial Court and poor or non payers will be listed with all credit bureaus. Both parties agree to the jurisdiction of Alberton Magistrates Court.
8. Members are entitled to utilize and access the facilities of Bodyguru subject to the payment and signature of this agreement and provided that Bodyguru may at any time withdraw part of its facilities for any period in connection with repair, alterations or refurbishment of the said facilities.
9. If Bodyguru ceases to operate, then the members membership shall be terminated and the member shall have no claim for damages against Bodyguru, save for a refund of a pro-rata amount of pre-paid membership fee, if any.
10. This agreement was duly and fully completed before signature by the member and the information contained herein is certified true and correct. Bodyguru reserves the right to cancel this contract should the information supplied herein be found to be incorrect and/or false.The Signator understood the contents of same.
11. Bodyguru may increase the monthly membership fee on an annual basis, provided that each member has been notified of such increase with at least 30 days notice.
12. It is the duty of the member to update their current information / details should they change at any time.

COOLING OFF PERIOD

You are entitled to terminate this agreement within 7 days from date of signature of this agreement, excluding Sundays and public holidays. The intended termination must be conveyed in writing and must be received by an official Bodyguru representative within the seven day period as defined.
